A MEMORIAL
REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO DIRECT THE APPROPRIATE COMMITTEE TO REVIEW ALL BILLS DEALING WITH ANNEXATION AND PREPARE RECOMMENDATIONS TO THE LEGISLATURE BY DECEMBER 2009.
WHEREAS, growth and development have become significant and controversial issues affecting all New Mexicans; and
WHEREAS, expansion of municipal boundaries has resulted in conflict with agricultural producers and strained relations among citizens and constituents; and
WHEREAS, political and social conflict are not in the best interests of New Mexico's economy or its citizens; and
WHEREAS, numerous bills have been introduced and deliberated in recent years to reform the state's annexation laws; and
WHEREAS, few participants can understand Section 3-7-17 NMSA 1978, which governs annexation procedures; and
WHEREAS, it is in the interests of all citizens and the courts that such important laws at least be comprehensible;
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF NEW MEXICO that the New Mexico legislative council be requested to direct the appropriate committee to hear testimony from key informed stakeholders regarding annexation and write legislation to clarify municipal annexation authority for consideration by the forty-ninth legislature, second session; and
BE IT FURTHER RESOLVED that a copy of this memorial be transmitted to the New Mexico legislative council.
