AN ACT
RELATING TO BUSINESS; PROHIBITING ISSUANCE OF A RETAIL LIQUOR LICENSE WITHIN ONE-HALF MILE OF AN INTERSTATE HIGHWAY IN NEW MEXICO; PROVIDING FOR TRANSFER OF AN EXISTING LIQUOR LICENSE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of the Liquor Control Act is enacted to read:
"[NEW MATERIAL] PROHIBITION ON ISSUANCE OF A NEW LIQUOR LICENSE WITHIN ONE-HALF MILE OF AN INTERSTATE HIGHWAY.--As of July 1, 2009, the director shall not issue a new retail or restaurant liquor license for a licensed premises within one-half mile of a United States interstate highway in New Mexico. By December 31, 2009, the director shall provide by rule for transfer of a licensed premises, including reimbursement for moving a restaurant or retail establishment, if the licensed premises lies within one-half mile of a United States interstate highway on July 1, 2009."
