AN ACT

RELATING TO MOTOR VEHICLES; REQUIRING A CERTIFICATE OF TITLE FOR HEAVY EQUIPMENT; ESTABLISHING A FEE; PROVIDING FOR THE UPGRADE AND MAINTENANCE OF THE COMPUTER SYSTEMS AND EQUIPMENT OF THE MOTOR VEHICLE DIVISION OF THE TAXATION AND REVENUE DEPARTMENT; MAKING AN APPROPRIATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 66-1-4.8 NMSA 1978 (being Laws 1990, Chapter 120, Section 9, as amended) is amended to read:

     "66-1-4.8. DEFINITIONS.--As used in the Motor Vehicle Code:

          A. "hazardous material" means a substance or material in a quantity and form that may pose an unreasonable risk to health, safety or property when transported in commerce;

          B. "heavy equipment" means engineering vehicles or construction equipment, including earth movers, cranes and crawlers;

          [B.] C. "highway" or "street" means every way or place generally open to the use of the public as a matter of right for the purpose of vehicular travel, even though it may be temporarily closed or restricted for the purpose of construction, maintenance, repair or reconstruction;

          [C.] D. "historic or special interest vehicle" means a vehicle of any age that, because of its significance, is being collected, preserved, restored or maintained by a collector as a leisure pursuit;

          [D.] E. "horseless carriage" means a motor vehicle at least thirty-five years old that is owned as a collector's item and used solely for exhibition and educational purposes; and

          [E.] F. "house trailer" means a manufactured home."

     Section 2. A new section of Chapter 66, Article 3 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] CERTIFICATE OF TITLE FOR HEAVY EQUIPMENT.--

          A. The owner of heavy equipment shall submit proof of ownership to the division for a certificate of title.

          B. The division shall issue a certificate of title, certifying ownership and displaying the vehicle identification number, serial number or other equivalent identification number of the heavy equipment, upon the showing of:

                (1) the manufacturer's certificate of origin;

                (2) the bill of sale;

                (3) the statement of title; or

                (4) satisfactory proof of ownership as determined by the division.

          C. The fee for a certificate of title for heavy equipment is twenty dollars ($20.00). The fees collected pursuant to this section are appropriated to the division to defray the costs of upgrading and maintaining computer systems and equipment."
