AN ACT

RELATING TO PUBLIC ASSISTANCE; REQUIRING THAT CERTAIN HOME- AND COMMUNITY-BASED WAIVER PROGRAMS MAKE ANNUAL PROVIDER COST-OF-LIVING ADJUSTMENTS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. COST-OF-LIVING ADJUSTMENTS TO PROVIDERS.--The department of health shall make annual cost-of-living adjustments in its reimbursements to service providers pursuant to the Developmental Disabilities Act. The cost-of-living adjustment shall be indexed to the current year's home health market basket, published by the federal department of health and human services' centers for medicare and medicaid services. .173578.1
