AN ACT
RELATING TO PLEA AGREEMENTS; REQUIRING COURTS TO PROVIDE NOTICE OF THE COLLATERAL CONSEQUENCES OF CONVICTION TO A DEFENDANT BEFORE ACCEPTING OR ENTERING JUDGMENT UPON A PLEA AGREEMENT; REQUIRING THE NEW MEXICO SENTENCING COMMISSION TO PROVIDE AND ANNUALLY UPDATE INFORMATION ON COLLATERAL CONSEQUENCES OF CONVICTION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. PLEA AGREEMENTS--NOTICE OF COLLATERAL CONSEQUENCES.--
A. A court shall provide a defendant with notice of the collateral consequences of conviction prior to accepting or entering a judgment upon a plea agreement.
B. The New Mexico sentencing commission shall provide to the administrative office of the courts and annually update a list of the collateral consequences of conviction.
Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2009.
