AN ACT

MAKING AN APPROPRIATION FOR THE LOW INCOME ENERGY ASSISTANCE

PROGRAM; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--One million nine hundred

thousand dollars ($1,900,000) is appropriated from the

general fund to the human services department for expenditure

in fiscal years 2009 and 2010 for the low income home energy

assistance program; provided, however, that the human

services department shall not expend any of this

appropriation on an outside contractor. Any unexpended or

unencumbered balance remaining at the end of fiscal year 2010

shall revert to the general fund.

Section 2. EMERGENCY.--It is necessary for the public

peace, health and safety that this act take effect

immediately.
