AN ACT

RELATING TO CAPITAL EXPENDITURES; MAKING AN APPROPRIATION FOR FLOOD DAMAGE REPAIR IN LINCOLN AND OTERO COUNTIES; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. GENERAL FUND APPROPRIATION--DEPARTMENT OF TRANSPORTATION PROJECT.--Five million dollars ($5,000,000) is appropriated from the general fund to the department of transportation for expenditure in fiscal years 2009 through 2013 to plan, design and construct improvements to roads and bridges damaged by severe flooding in Lincoln and Otero counties. This amount is in addition to, and is not intended to supplant, any federal emergency management assistance funds provided by the federal government. Any unexpended or unencumbered balance remaining at the end of fiscal year 2013 shall revert to the general fund.

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
