AN ACT

MAKING AN APPROPRIATION FOR IMPROVEMENTS AT THE PASEO DEL NORTE AND INTERSTATE 25 INTERCHANGE; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--Two hundred million dollars ($200,000,000) is appropriated from the general fund to the department of transportation for expenditure in fiscal years 2009 through 2011 to plan, design, construct and make improvements to the Paseo del Norte and interstate 25 interchange in Albuquerque in Bernalillo county. Any unexpended or unencumbered balance remaining at the end of fiscal year 2011 shall revert to the general fund.

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
