SUMMARY
Synopsis of Bill
Senate Memorial 34 requests the NMDOT, NM Association of Counties, tribal and local
governments and other jurisdictions to complete a study to develop options and
recommendations to facilitate timely relocation of utility facilities located within public rights of
way that would be of mutual benefit to public agencies and utilities in minimizing costs,
disruption of services and project delays in highway construction activities.
SIGNIFICANT ISSUES
NMDOT indicates that a study of this type “…present an opportunity to address some of the
issues by changing the approach to utility relocation by utilizing existing processes that may not
always be embraced by highway or utility design and construction personnel and by adopting
new processes that will facilitate both highway and utility requirements. Whatever approach is
ultimately adopted, the focus of such process is to get all players State, County, City and others
in the process early."
