if they are used for other purposes.

Adobe PDF versions include all attachments, whereas HTML versions may not. Previously issued FIRs and

Synopsis of Bill
Senate Joint Resolution 7 proposes to amend the New Mexico Constitution by adding a new
section to article 4 allowing for the enactment of laws prohibiting any executive regulatory rule
from taking effect until said rule(s) can be evaluated and approved by the appropriate standing or
interim committee(s). Also, Senate Joint Resolution 7 proposes enactment of laws which
empower the proper committee(s) and gives said committees the ability to rescind the rule if said
committee finds that the executive did not have proper authorization to adopt the rule.
Sub-section (A) gives the legislature authority to prohibit enactment of regulatory rules without
proper review and approval by the appropriate standing or interim committee(s). Sub-section (B)
empowers the proper committee, interim or standing, to review and annul any rule adopted by an
agency or officer of the executive branch. Sub-section (C) allows for the enactment of a law,
pursuant to Sub-sections (A) and (B), which sets procedures for selection of the rules subject to
review. Said law will set procedures for selecting the proper committee(s), and for ensuring that
rules needed to address emergency situations are not impeded by the review process.
This amendment will be submitted for public approval at the next general election, or at a special
election called for this purpose only.
