SUMMARY
Synopsis of Bill
SB 499 proposed the creation of a task force that would study the feasibility of implementing
DWI drunk prevention technology in New Mexico that would use driver’s licenses to
electronically register the amount and type of alcoholic liquor purchase by the holder of a
driver’s license from a business that sells or serves alcohol to the public.
This task force is to be composed of the following members:
Director of the Alcohol and Gaming Division of the Regulation and Licensing Department or
designee;
Director of the Motor Vehicle Division of the Taxation and Revenue Department or
designee;
Chief of the Traffic Safety Bureau of the Department of Transportation;
Secretary of Public Safety or designee;
A representative from the New Mexico Sheriffs’ and Police Association; and
Seven members appointed by the Governor.

FISCAL IMPLICATIONS
Senate Bill 499 also provides an appropriation of two hundred fifty thousand dollars ($250,000)
from the General Fund to the Alcohol and Gaming Division of the Regulation and Licensing
Department for the DWI Drunk Prevention Technology Task Force to expend, including the
acquisition of a pilot project that demonstrates the DWI drunk prevention technology. Any
unexpended or unencumbered balance remaining at the end of FY09 shall revert to the general
fund.
SIGNIFICANT ISSUES
This bill could improve the overall operation of the criminal justice system and help to decrease
recidivism.
ALTERNATIVES
There is currently a D.W.I. Leadership Team headed by D.W.I. Czar Rachel O’Conner
comprised of many experts in this area, some of which are requested by the legislation to be on
the task force. It might be a better use of resources and avoid duplication of efforts if the
Leadership Team be asked to review these issues.
