Synopsis of Bill
Senate Bill 272 relates to New Mexico Counties’ health care providers and the setting of health
care provider rates for care delivered to persons in County jail custody. This Senate Bill defines
two types of County jail health care providers.
Section 1 of this Senate Bill defines ‘health care provider and reimbursements’ as follows’:
1. a person who provides health care, including mental health care, to a person in the custody of
a county jail shall charge the county for health care as follows:
A. a ‘Medicaid’ provider, as defined in Subsection D of Section 27-11-2 NMSA 1978,
shall charge at the same rate that the provider charges the human services department for
‘Medicaid’ recipients, as defined in Subsection F of Section 27-11-2 NMSA 1978; and
B. a provider who is not a ‘Medicaid’ provider but who accepts reimbursement from the
state for all or part of a patient's care shall charge the county at the highest rate that the state
reimburses the provider for the same care pursuant to another program.
FISCAL IMPLICATIONS
This Senate Bill requests no funding. There is a companion Senate Bill 385 that contemplates
that both County Funds and the General Fund will save money. County jails will pay the lowest
rate for medical service. This rate will be equal to the same rate charged to other payers. Savings
that many accrue to county budgets are unknown.
