SUMMARY

Synopsis of Bill

Senate Bill 107 appropriates $100.0 from the general fund to the Tourism Department, Sports

Authority Division to purchase and distribute to students tickets to attend the "learning at the

game" events at professional basketball games.

FISCAL IMPLICATIONS

The appropriation of $100.0 contained in this bill is a recurring expense to the general fund. Any

unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall revert to the

general fund.

SIGNIFICANT ISSUES

The PED states:

During the 2007 Legislature SB 611 was passed for FY 2008. The bill provided $5.0 to

purchase and distribute tickets to school students for semiprofessional basketball

games.

The PED was the administering agency for the $5.0. The appropriation allowed for the

purchase of 500 tickets at $1.0 each and transportation to and from the event. The event

that will take place during a semiprofessional game is titled “the school house jam."

“The school house jam" event will take place on Wednesday, January 23, 2008 and on

Tuesday, February 5, 2008. The events will take place at 10:30 a.m. during the school

day.

A consequence of the bill would be the substitution of state monies for private monies.

•

The taxpayer might perceive this appropriation to be a subsidy for semiprofessional

basketball.

During the above events the following is to take place (B, Widner, New Mexico

1. guests from Mothers Against Drunk Driving and APD party patrol will address the

dangers of underage drinking.

2. educational workbooks will be distributed to each child teaching various lessons through

a basketball theme. The workbook is created by the Albuquerque Journal Newspapers

Education staff and is designed to cross over several age groups and provide lessons

that teachers can use to get kids excited about learning.

TECHNICAL ISSUES

The PED points out that this bill may violate the anti-donation clause of the New Mexico

Constitution.
