House Joint Resolution 5 seeks to amend Article 6, Section 35 of the Constitution of New
Mexico relating to certain judicial offices and primary and general election procedures.
SIGNIFICANT ISSUES
House Joint Resolution 5 proposes an amendment to Article 6, Section 35 of the Constitution of
New Mexico to allow certain judicial offices, filled by appointment, to serve at least one full year
on the bench before an election is held to fill that office.
This Joint resolution must be approved by the Voters of New Mexico.
PERFORMANCE IMPLICATIONS
The proposed joint resolution could help attract more qualified candidates as applicants for
judgeships, knowing that they would serve at least one full year before they would have to seek
election.
