SUMMARY
Synopsis of Bill
House Bill 461, Making an Appropriation for the Hispanic National Bar Associations’ Annual
Convention in October 2009, appropriates $50.0 thousand from the general fund to DFA for the
purpose of the Hispanic National Bar Association conference.
FISCAL IMPLICATIONS
The appropriation of $50.0 thousand contained in this bill is a non-recurring expense to the
general fund. Any unexpended or unencumbered balance remaining at the end of FY09 shall
revert to the general fund.
SIGNIFICANT ISSUES
DFA notes that the Local Government Division has a reimbursement mechanism in place to
manage this appropriation. However, the state constitution anti-donation provisions prohibit
monies going directly to non-profit organizations. The appropriation would either flow through
the Local Government Division to an authorized fiscal agent of the state which would follow
standard procurement guidelines to award a contract for the purposes of the appropriation, or the
Local Government Division would have to administer the appropriation and ensuing
procurement and contract.
