SUMMARY
Synopsis of HVEC Amendment
The House Voters and Elections Committee amendment adds an emergency clause to make the
act take effect immediately.
Synopsis of Original Bill
House Bill 438 appropriates $176 thousand from the GENERAL FUND to the Office of the
Secretary of State to enhance the usability of the political finance reporting system, including
electronic filing capabilities, electronic signature authentication and an internet-based, searchable
database to access and search for information in campaign finance reports.
FISCAL IMPLICATIONS
This appropriation duplicates the General Appropriation Act, Section 7, Subsections 18 and 19.

Specifically, Subsection 18 appropriates $176.5 thousand to the Secretary of State for
knowledgebase campaign reporting system to include records management, area code changes
and Help America Vote Act voter identification requirements. Subsection 19 extends the period
of time for the Secretary of State to expend $112 thousand to complete the implementation of
trademark, agricultural lien and campaign reporting modules of the knowledgebase application.
The appropriation of $176 thousand contained in this bill is a NON RECURRING expense to the
GENERAL FUND. Any unexpended or unencumbered balance remaining at the end of FISCAL
YEAR 2009 shall revert to the GENERAL FUND.
SIGNIFICANT ISSUES
Association of County Clerks point out that the vendor that currently provides the type of system
indentified in the bill is
the same vendor as the on that provides New Mexico its voting machines
and the statewide voter registration systems, and the vendor has proved to be highly unreliable
with both these products. Purchasing another product and service from this vendor could also be
a possible monopoly.
