SUMMARY
Synopsis of Bill
House Bill 365 appropriates $315 thousand from the general fund to Public Education
Department for the purpose of developing and implementing English Language Learner
programs in the Santa Rosa and Floyd, Portales and Fort Sumner school districts.
FISCAL IMPLICATIONS
The appropriation of $315 thousand contained in this bill is a recurring expense to the general
fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall
revert to the general fund.
SIGNIFICANT ISSUES
The LFC remains concerned with funding initiatives outside of the funding formula as it tends to
disequalize school funding and diverts funding away from core educational needs.
Funding for these types of programs is included in HB-2 for the state equalization guarantee
distribution to districts. Districts are free to prioritize programs as they see fit to meet
community needs within overall program requirements of PED.
