SUMMARY

Synopsis of Bill

House Bill 316 appropriates $1,000.0 from the general fund to the Higher Education Department

to contract for the provision of a community concert series, a community lecture series, peer

education of high school and college-aged students and conflict resolution programs, as well as

documentary and history projects, efforts to attract movie production to Santa Fe and other

support for local continuing education programs in the Santa Fe area.

FISCAL IMPLICATIONS

The appropriation of $1,000.0 contained in this bill is a recurring expense to the general fund.

Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall revert

to the general fund.

This request was not submitted to the New Mexico Higher Education Department for review and

is not included in the Department’s funding recommendation for FY09.

SIGNIFICANT ISSUES

The HED states that the department does not see a clear connection between its mission and the

SB245 request. The department would find it very difficult to develop performance measures for

the program and activities listed in the bill. SB245 attempts to cover a broad list of programs and

activities that are seemingly unrelated. The appropriation lacks focus regarding a targeted need in

the Santa Fe community and a targeted population to benefit from the programs and activities

mentioned in the bill. For instance, peer education and conflict resolution programs for high

school and college-aged (not enrolled) students are mentioned along with attracting movie

production. These programs would fall under education, more likely public schools, and

economic development respectively. NMHED is not a likely oversight agency for SB245.

The HED notes also that it has no flow through mechanism in place to allocate or spend the

requested funds.

According to the EDD, efforts to attract movie production to Santa Fe are not in the realm of

education and it is unclear why this is included.
