SUMMARY
Synopsis of Bill
House Bill 263 amends Section 4-41-16, regarding the sheriffs of New Mexico collection of fees
and compensation for serving process, to increase the fee from $30 to $40 for serving every writ,
citation, order, subpoena or summons.
FISCAL IMPLICATIONS
Sheriff offices can charge anyone, except the state or any state agency, for serving legal papers
such as subpoena or summons in a civil action. Fees collected for service of process go directly
into the affected county’s general fund. This fee increase will result in an increase of such
revenue, but estimates of the amount of such revenue increase are not yet available
SIGNIFICANT ISSUES
Private Citizens who initiate the service of process by the state’s sheriffs could be charged an
additional $10 dollars.
