SUMMARY
Synopsis of Bill
House Bill 122 appropriates $3,000,000 from the general find to the NM Department of
Transportation (NMDOT) for expenditure in fiscal years 2009 and 2010 for the acquisition of
rights of way, planning, design and construction of an overpass over the Burlington Northern
Santa Fe (BNSF) railroad on State Route 109 just south of Lazy Lane near Jarales in Valencia
County.
FISCAL IMPLICATIONS
The appropriation of $3,000,000 contained in this bill is a nonrecurring expense to the general
fund. Any unexpended or unencumbered balance remaining at the end of FY2010 shall revert to
the general fund. The NMDOT indicates that this is not enough funding to complete the project.
SIGNIFICANT ISSUES
HB 122 appropriates $3,000,000 for acquisition of rights of way, planning, design and
construction of this railroad overpass. However, the NMDOT reports that this amount is
insufficient to complete the project as described in the bill. A similar project at Aragon Road,
2.55 miles north on the same rail line, is currently under construction at a total cost of
$6,800,000.
