AN ACT

RELATING TO TRANSPORTATION; MAKING AN APPROPRIATION FOR THE COMPLETION OF CERTAIN AUTHORIZED TRANSPORTATION PROJECTS; PROVIDING CRITERIA FOR DISTRIBUTION OF THE APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION--TRANSPORTATION PROJECTS.--

          A. Fifty million dollars ($50,000,000) is appropriated from the general fund to the department of transportation for expenditure in fiscal years 2009 through 2011 for the purpose of completing those projects authorized in Paragraphs (1) and (3) through (38) of Subsection A of Section 27 of Chapter 3 of Laws 2003 (1st S.S.), provided that the department shall comply with the requirements of Subsections C, D and E of Section 67-3-59.4 NMSA 1978. Any unexpended or unencumbered balance remaining at the end of fiscal year 2011 shall revert to the general fund.

          B. The money appropriated in Subsection A of this section shall be expended for projects in each of the six state transportation commission districts pursuant to a distribution methodology developed by the department of transportation that shall take into consideration the total highway mileage in each district.
