AN ACT
RELATING TO ELECTIONS; CLARIFYING OWNERSHIP OF STATE-PURCHASED VOTING SYSTEMS; PROVIDING FOR MAINTENANCE AND STORAGE OF STATE-OWNED VOTING SYSTEMS; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of the Election Code is enacted to read:
"[NEW MATERIAL] VOTING SYSTEMS--STATE OWNERSHIP--MAINTENANCE.--
A. Ownership of voting systems purchased by the secretary of state for use by a county shall not be transferred to the county without permission of the board of county commissioners of that county.
B. State-owned voting systems shall be maintained by the state and may be stored in the counties using the voting systems pursuant to guidelines issued by the secretary of state."
Section 2. APPROPRIATION.-Four hundred thousand dollars ($400,000) is appropriated from the general fund to the office of the secretary of state for expenditure in fiscal year 2009 to pay for the maintenance of voting systems owned by the state. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall revert to the general fund.
