    Your RULES COMMITTEE, to whom has been referred


SENATE BILL 387


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. On page 1, line 11, strike "CERTAIN".


    2. On page 1, line 12, after "PERSONS" insert "AND POLITICAL COMMITTEES".


    3. On page 1, line 18, after "CANDIDATES" insert "AND POLITICAL COMMITTEES".


    4. On page 1, line 19, through page 2, line 10, strike Subsections A and B in their entirety and insert the following new subsections:

 

         "A. The following contributions shall not knowingly be made by the following persons, directly or indirectly, including a contribution earmarked or otherwise directed or coordinated through a third party:

 

             (1) from a person, not including a political committee, to a:


                  (a) candidate for nonstatewide office, including the candidate's campaign committee or treasurer of the campaign committee, in an amount that will cause that person's aggregate amount of contributions to the candidate to exceed two thousand three hundred dollars ($2,300) during the primary election or two thousand three hundred dollars ($2,300) during the general election;


 



                  (b) candidate for statewide office, including the candidate's campaign committee or treasurer of the campaign committee, in an amount that will cause that person's aggregate amount of contributions to the candidate to exceed five thousand dollars ($5,000) during the primary election or five thousand dollars ($5,000) during the general election; or


                  (c) political committee, in an amount that will cause that person's aggregate amount of contributions to the political committee to exceed fifteen thousand dollars ($15,000) during the primary election, fifteen thousand dollars ($15,000) during the general election or fifteen thousand dollars ($15,000) during a statewide special election; and


             (2) from a political committee to:


                  (a) a candidate for nonstatewide office, including the candidate's campaign committee or treasurer of the campaign committee, in an amount that will cause that political committee's aggregate amount of contributions to the candidate to exceed five thousand dollars ($5,000) during the primary election or five thousand dollars ($5,000) during the general election;


                  (b) a candidate for statewide office, including the candidate's campaign committee or treasurer of the campaign committee, in an amount that will cause that political committee's aggregate amount of contributions to the candidate to exceed seven thousand five hundred dollars ($7,500) during the primary election or seven thousand five hundred dollars ($7,500) during the general election; or


                  (c) another political committee, that will cause that political committee's aggregate amount of contributions to the political committee to exceed fifteen thousand dollars ($15,000) during the primary election, fifteen thousand dollars ($15,000) during the general election or fifteen thousand dollars ($15,000) during a statewide special election.


          B. A candidate, a candidate's campaign committee, a treasurer of a campaign committee or a political committee shall:


             (1) not knowingly accept or solicit a contribution, directly or indirectly, including a contribution earmarked or otherwise directed or coordinated through a third party, that violates the contribution limits provided for in this section; and


             (2) return a contribution that exceeds the contribution limits provided for in this section to the person who made the contribution.".


    5. On page 2, line 11, after "On" insert "January 1, 2009 and on".


    6. On page 2, line 12, strike "Subsections A and B" and insert in lieu thereof "Subsection A".


    7. On page 2, between lines 22 and 23, insert the following new section:


    "Section 2. APPLICABILITY--NONSTATEWIDE AND STATEWIDE CANDIDATES.--The provisions of this act shall apply to candidates for:


         A. nonstatewide office on or after January 1, 2009; and

 

         B. statewide office on or after January 1, 2011.".


    8. Renumber the succeeding section accordingly.,


and thence referred to the JUDICIARY COMMITTEE.
