AN ACT
RELATING TO PUBLIC SCHOOLS; MANDATING RANDOM DRUG TESTING FOR ANABOLIC STEROIDS IN HIGH SCHOOL VARSITY ATHLETIC PROGRAMS; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section. 1. A new section of the Public School Code is enacted to read:
"[NEW MATERIAL] HIGH SCHOOL VARSITY ATHLETICS--RANDOM DRUG TESTING FOR ANABOLIC STEROIDS.--
A. By August 1, 2008, all local school boards within the state shall implement rules and procedures and begin conducting random drug testing for anabolic steroid use among varsity high school athletes. Rules and procedures developed by local school boards shall include protocols for addressing positive anabolic steroid test results.
B. As a condition of participating in a varsity-level athletic program, a potential participant or the parent, custodian, legal representative or guardian of a potential participant must provide written consent to being tested for anabolic steroids.
C. As used in this section, "varsity-level athletic program" means an extracurricular athletic program offering the highest level of competition offered by one school or school district against the highest level of competition offered by an opposing school or school district."Section 2. APPROPRIATION.--One million dollars ($1,000,000) is appropriated from the general fund to the public education department for expenditure in fiscal years 2009 and 2010 to fund the implementation and operation of random drug testing for varsity high school athletic participants. Any unexpended or unencumbered balance remaining at the end of fiscal year 2010 shall revert to the general fund.
Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2008.
