Mr. Speaker:
Your TAXATION AND REVENUE COMMITTEE, to whom has been referred
HOUSE BILL 400, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 9, line 21, after the second occurrence of "property", insert "solely".
2. On page 9, line 22, strike "uses and".
3. On page 9, line 23, after "purposes", insert a semicolon and the following:
"provided, however, that if the district determines that all or a part of the property acquired pursuant to this paragraph is not necessary or desirable, the district may offer the unnecessary or undesirable portion of the property for sale, lease or trade. If the determination is made within five years of the date of acquisition under this paragraph, and notwithstanding the provisions of Chapter 13, Article 6 NMSA 1978, the district may first offer that property to the party from whom the property was acquired pursuant to Section 42-2-23 NMSA 1978".
4. On page 11, line 1, after "district", insert ", including transit services provided pursuant to contracts with regional transit district transit providers or local transit providers".
5. On page 18, line 20, after the period, strike the remainder of the line, strike lines 21 and 22 in their entirety and strike line 23 through the period and insert in lieu thereof "Within seventy-five days of the date the ordinance imposing the tax is adopted, each governing body shall adopt a resolution calling for a joint election on the question of imposing the tax.".
