AN ACT

MAKING AN APPROPRIATION TO THE NEW MEXICO SENTENCING COMMISSION TO CONVENE A TASK FORCE TO STUDY THE COLLATERAL CONSEQUENCES OF CRIMINAL ARREST, CONVICTION AND INCARCERATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--Fifty thousand dollars ($50,000) is appropriated from the general fund to the New Mexico sentencing commission for expenditure in fiscal year 2009 to convene a task force to study the collateral consequences of criminal arrest, conviction and extended periods of incarceration and to make recommendations on how to neutralize or eliminate those consequences to the appropriate interim legislative committee before November 1, 2008. The task force shall include representatives from the New Mexico district attorneys association, the public defender department, the university of New Mexico school of law, the New Mexico criminal defense lawyers association, the New Mexico women's justice project, the parole board, the adult probation and parole division of the corrections department and any other interested persons whose expertise may be beneficial to the task force. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall revert to the general fund.
