AN ACT

MAKING AN APPROPRIATION TO THE NEW MEXICO SENTENCING COMMISSION FOR A PROJECT TO REVIEW THE PREVALENCE AND RESULTS OF APPEALS OF DWI CASES TO DISTRICT COURTS IN NEW MEXICO.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--Twenty-two thousand two hundred seventy-four dollars ($22,274) is appropriated from the general fund to the New Mexico sentencing commission for expenditure in fiscal year 2009 for a project to review the prevalence and results of all de novo appeals of DWI cases to district courts in New Mexico over a three-year period. The project shall not include a review of de novo appeals of DWI cases to the Bernalillo county district court. The New Mexico sentencing commission shall submit a final report of the project to the legislature by January 1, 2009. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall revert to the general fund.
