Mr. Speaker:

 

    Your EDUCATION COMMITTEE, to whom has been referred

 

HOUSE BILL 3

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

     1. On page 2, line 12, strike the dollar amount under the General Fund column and insert in lieu thereof "2,419,218.2".

 

     2. On page 2, strike lines 21 through 25 and on page 3, strike lines 1 through 3, and insert in lieu thereof:

 

     “The general fund appropriation to the state equalization guarantee distribution includes fifty-eight million seven hundred and sixty-seven thousand nine hundred and forty-four dollars ($58,767,944) provide an average three percent salary increase for all teachers, other instructional staff, and other certified and non-certified school employees, effective July 1, 2008. Prior to the approval of a school district’s or charter school’s budget, the secretary of public education shall verify that each school district or charter school is providing an average three percent salary increase for all teachers and other licensed school employees and an average three percent salary increase for non-certified school employees.

 

    The general fund appropriation to the state equalization guarantee distribution includes sufficient funds to provide an additional two percent average salary increase for secretarial, clerical, and technical assistants; business office support staff; maintenance, custodial, warehouse, and delivery employees; and food service employees . The secretary of public education shall verify that school districts and charter schools have implemented an average three percent salary increase for these public school employees prior to the implementation of the additional two percent average salary increase for these employees.”

 

     3. On page 3, between lines 9 and 10, insert:

 

     "The general fund appropriation to the state equalization guarantee distribution contains one million five hundred thousand dollars ($1,500,000) to cover costs associated with due process reimbursement insurance coverage, contingent on Senate Bill 145 or similar legislation of the second session of the forty-eighth legislature becoming law.

 

     The general fund appropriation to the state equalization guarantee distribution contains two hundred thousand dollars ($200,000) to obtain insurance against claims arising from the use of school facilities by private persons, contingent on House Bill 19 or similar legislation of the second session of the forty-eighth legislature becoming law.".

 

     4. On page 3, strike lines 17 through 19 and insert in lieu thereof:

 

     "The general fund appropriation to the state equalization guarantee distribution contains sufficient funding to increase the school year by one instructional day.

 

     The general fund appropriation to the state equalization guarantee distribution contains sufficient funding to increase the school year by one-half day to be used by school districts and charter schools to conduct professional development focused on teacher-parent training.".

 

     5. On page 4, line 14, strike the dollar amounts and insert in lieu thereof "112,109.8".

 

     6. On page 4, strike lines 15 through 17 and insert in lieu thereof:

 

            “The general fund appropriation for the transportation distribution contains one million three hundred sixty-two thousand ($1,362,000) to provide an average three percent salary increase for transportation employees, effective July 1, 2008. Prior to the approval of a school district’s or charter school’s budget, the secretary of public education shall verify that each school district or charter school is provided an average three percent salary increase for these employees.

 

         The general fund appropriation to the transportation distribution includes sufficient funds to provide an additional two percent average salary increase for transportation employees. The secretary of public education shall verify that school districts and charter schools have implemented an average three percent salary increase for these public school employees prior to the implementation of the additional two percent average salary increase for these employees.

 

            The general fund appropriation to the transportation distribution includes three hundred thirty-six thousand six hundred dollars ($336,600) for transporting students enrolled in kindergarten-three plus programs approved by the public education department.”

 

     7. On page 5, line 3, strike the dollar amounts and insert in lieu thereof "43,000.0".

 

     8. On page 5, between lines 8 and 9, insert the following new item, with the dollar amount inserted under the General Fund column:

 

     "MATHEMATICS AND SCIENCE PROFICIENCY FUND  2,500.0". 

 

     9. On page 5, line 10, strike the dollar amounts and insert in lieu thereof "2,500.0".

 

     10. On page 5, line 12, strike the dollar amount and insert in lieu thereof "five hundred thousand dollars ($500,000)".

 

     11. On page 5, lines 14 and 15, strike the dollar amount and insert in lieu thereof "two hundred fifty thousand dollars ($250,000)".  

 

     12. On page 5, between lines 15 and 16, insert:

 

     "The general fund appropriation to the public education department for the teacher professional development fund includes two hundred fifty thousand dollars ($250,000) to be transferred to the higher education department to provide professional development through community colleges for middle and high school teachers and to purchase site licenses for web-based mathematics learning resources for students in schools with the highest proportion of students in need of academic improvement in the Albuquerque, Clovis, Hobbs, Las Cruces, Gallup-McKinley and Zuni public school districts.

 

     The public education department may enter into multi-year contracts in accordance with the Procurement Code in expending funds appropriated to the teacher professional development fund.".

 

     13. On page 6, strike lines 11 through 25, strike all of page 7, on page 8, strike lines 1 and 2 and insert in lieu thereof the following, with the dollar amounts under the General Fund column:

 

    "RECURRING SPECIAL APPROPRIATIONS:

    TO THE PUBLIC EDUCATION DEPARTMENT:

         (a) Advanced placement                         2,000.0

         (b) After-school enrichment program            3,500.0

         (c) Beginning teacher mentorship               2,000.0

         (d) Breakfast for elementary students          3,500.0

         (e) Family and Youth Resource Act              2,500.0

         (f) Food to schools (to be transferred to the

    The general fund appropriation to the public education department for advanced placement includes four hundred thousand dollars ($400,000) to be transferred to the board of regents of eastern New Mexico university to provide high-quality curricula in kindergarten through sixth grade to prepare students for pre-advanced placement and advanced placement courses in grades seven through twelve.

 

    The general fund appropriation to the public education department for the after-school enrichment program includes one million five hundred thousand dollars ($1,500,000) to be allocated to twenty-first century community learning centers statewide that in the 2007-2008 school year are in their final year of eligibility for federal funding.

 

    The general fund appropriation to the public education department for the New Mexico cyber academy includes nine hundred thirty thousand dollars ($930,000) for course development, professional development, agency training, student services and supplies for the statewide cyber academy; five hundred thousand dollars ($500,000) for the department's operating budget; and two hundred forty thousand dollars ($240,000) for the regional education cooperatives distance learning network for regional education cooperatives 3, 8 and 9 and expansion to three additional cooperatives.

 

    The general fund appropriation to the public education department for rural education and community revitalization and parental training and involvement includes one hundred thousand dollars ($100,000) to contract with a New Mexico nonprofit organization that can provide statewide comprehensive training with teams of teachers and parents, facilitate family leadership training and publish manuals in both English and Spanish for parents and teachers.".

 

    14. On page 8, strike lines 19 through 21 and insert in lieu thereof the following appropriations, with the dollar amounts under the General Fund column:

 

    "TO THE ENERGY, MINERALS AND NATURAL RESOURCES DEPARTMENT:

    TO THE HIGHER EDUCATION DEPARTMENT:

    IDEAL-NM expansion                                   850.0

 

    The general fund appropriation to the public education department for the New Mexico school for the arts is contingent on Senate Bill 34 or similar legislation of the second session of the forty-eighth legislature becoming law.

 

    The general fund appropriation to the public education department for the school improvement framework includes five hundred thousand dollars ($500,000) to contract with a nonprofit organization to provide in-school, after-school and summer supplementary literacy programs for children in rural areas attending schools in need of improvement ranked as subject to corrective action pursuant to the Assessment and Accountability Act, contingent on two hundred fifty thousand dollars ($250,000) in matching funds from other than state sources. The literacy programs shall be designed to serve children in kindergarten through eighth grade, shall include pre- and post-assessments that use normal curve equivalency measurements and shall provide staff development.

 

    The general fund appropriation to the public education department for the school improvement framework includes six hundred fifty thousand dollars ($650,000) to be transferred to the board of regents of New Mexico highlands university for the center for the education and study of diverse populations to provide technical assistance and training for schools and school districts, training in data-driven decision-making and data analysis, training in best practices for standards-based instruction and sheltered English instructional strategies.

 

    The general fund appropriation to the public education department for the STARS district training and support pilot program is to fund one full-time-equivalent term position to provide on-site instruction and technical assistance to school district staff to ensure that data entered into the student teacher accountability reporting system is accurate and submitted in a timely manner.

 

    The period of time for expending the one million five hundred thousand dollars ($1,500,000) appropriated from the separate account of the appropriation contingency fund dedicated for the purpose of implementing and maintaining educational reforms created in Section 12 of Chapter 114 of Laws 2004 contained in Subsection 102 of Section 5 of Chapter 28 of Laws 2007 for the eleventh grade exit examination is extended through fiscal year 2009.".

 

    15. On page 8, line 24, strike the dollar amounts and insert in lieu thereof "2,114.1".

 

    16. On page 9, between lines 7 and 8, insert the following appropriations with the dollar amount of the first appropriation under the General Fund column and the dollar amounts of the last three appropriations under the Other State Funds column:

 

 

    "DATA PROCESSING APPROPRIATIONS:

    COMPUTER SYSTEMS ENHANCEMENT FUND       5,327.0

    For information technology systems projects.               

    PUBLIC EDUCATION DEPARTMENT                          2,927.0

    To the public education department from the computer systems enhancement fund to continue the implementation of the student teacher accountability reporting system.

 

    PUBLIC EDUCATION DEPARTMENT                         1,400.0

    To the public education department from the computer systems enhancement fund to integrate the common public education department and higher education department student identifier into the student teacher accountability reporting system.

 

    HIGHER EDUCATION DEPARTMENT                          1,000.0

    To the higher education department from the computer systems enhancement fund to cover the costs of maintenance, information technology services and licensing fees associated with the further implementation of the innovative digital education and learning program.".

 

    17. Revise all totals and subtotals to correspond with these amendments.,
