SENATE FLOOR AMENDMENT number ___1___ to HOUSE BILL 6, as amended

    1. On page 17, lines 24 and 25, strike Section 12 in its entirety and insert in lieu thereof the following new section:

    "Section 12. CONTINGENT EFFECTIVE DATE.--The provisions of

this act shall become effective upon certification by the

secretary of state that the constitution of New Mexico has been

amended no later than December 31, 2008 as proposed by a joint resolution of the legislature that amends Article 6, Section 33 of the constitution of New Mexico to abolish nonpartisan retention elections for justices of the supreme court and judges of the court of appeals and to require those justices and judges to be elected to their positions in partisan elections.".
