A JOINT MEMORIAL
REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO DIRECT THE
APPROPRIATE INTERIM COMMITTEE TO STUDY THE NEW MEXICO
SUBDIVISION ACT.
WHEREAS, New Mexico counties are subject to the provisions
of the New Mexico Subdivision Act; and
WHEREAS, many New Mexico land divisions are being created
pursuant to thirteen exemptions allowed by the New Mexico
Subdivision Act; and
WHEREAS, properties are being divided and subdivisions
created without compliance with the provisions of the New
Mexico Subdivision Act through transfer of real property by
means of transfers on death deeds; and
WHEREAS, exemptions from the New Mexico Subdivision Act do
not currently include a requirement of documentation that all

tax obligations are current on land parcels and are assessed on
rolls in the assessors' offices in the name of the current
owner; and
WHEREAS, precise definitions of terms are necessary to
implement the New Mexico Subdivision Act;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
STATE OF NEW MEXICO that the New Mexico legislative council be
requested to direct the appropriate interim legislative
committee to study the New Mexico Subdivision Act, including
review of the state's statutes relating to exemptions allowed
in the act, the transfer of deeds upon death, tax and
assessment obligations and definition of terms; and
BE IT FURTHER RESOLVED that the interim legislative
committee report its findings and recommendations for
legislation to the second session of the forty-eighth
legislature; and
BE IT FURTHER RESOLVED that copies of this memorial be
transmitted to the members of the New Mexico legislative
council.
