A JOINT MEMORIAL
REQUESTING THE NEW MEXICO ASSOCIATION OF COUNTIES AND THE NEW
MEXICO MUNICIPAL LEAGUE TO ASSEMBLE AN EXTRATERRITORIAL TASK
FORCE TO STUDY THE LAWS GOVERNING PLANNING, ZONING, ANNEXATION
AND LAND DEVELOPMENT IN THE EXTRATERRITORIAL ZONES AND MAKE
RECOMMENDATIONS.
WHEREAS, various state laws address growth and development
in the extraterritorial areas immediately surrounding
municipalities; and
WHEREAS, existing laws fail to require an adequate level
of service delivery and intergovernmental cooperation among the
state, municipalities, counties and school districts; and
WHEREAS, extraterritorial land use has become a
battleground of competing interests, resulting in decisions
that are focused more on tax implications than on the greater

public good; and
WHEREAS, expanded residential growth into rural areas, and
the resulting demand for urban levels of services in rural
areas, can be very expensive for a local government to
adequately provide; and
WHEREAS, many other states have reformed their land use
laws to require that local governments work together in serving
the infrastructure and service needs of their constituents; and
WHEREAS, increased intergovernmental cooperation would
result in a more efficient use of existing resources;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
STATE OF NEW MEXICO that the New Mexico association of counties
and the New Mexico municipal league be requested to assemble an
extraterritorial task force to review and recommend changes to
the laws governing the planning, zoning, annexation and
development of lands in the extraterritorial zones; and
BE IT FURTHER RESOLVED that the task force be comprised of
four members appointed by the New Mexico municipal league and
four members appointed by the New Mexico association of
counties; and
BE IT FURTHER RESOLVED that the task force study issues
relating to land use in the extraterritorial areas around
municipalities, including zoning, subdivision, annexation,
levels of services, location of schools, financing of
infrastructure and taxation; and

BE IT FURTHER RESOLVED that the task force recommend
reforms of extraterritorial, municipal and county planning
bodies and related laws; and
BE IT FURTHER RESOLVED that the task force report to the
governor and the legislature by November 1, 2007 with
recommendations for proposed reforms; and
BE IT FURTHER RESOLVED that copies of this memorial be
transmitted to the New Mexico municipal league, the New Mexico
association of counties and the governor.
