SUMMARY

Synopsis of Bill

Senate Joint Memorial 61 requests the PED to encourage all secondary schools to provide

balanced information about critical life choices involving the military and to undertake a study to

determine if there is balance to military recruiters’ messages.

SIGNIFICANT ISSUES

Senate Joint Memorial 61 focuses on:

•

the requirement in the federal No Child Left Behind Act of 2001 (NCLB) that requires

school districts receiving federal funds to permit military recruiters to have access to

students’ names, addresses and telephone listings;

•

the federal requirement that school districts admit recruiters to the same extent as

colleges or employers; this carries an impact in time, costs, risks and educational mission

upon secondary schools;

•

the frequency of visits’ resulting in incompatibility with local control over secondary

school curricula;

•

uniformed military members being regarded by students as persons of authority or

special trust;

•

the hundreds of cases of military recruiter improprieties, misconduct, and criminal

convictions reported in the last two years;

•

the risks involved in being recruited; and

•

the amount being spent by the military to recruit exceeds $4 billion per year.

CONFLICT, DUPLICATION, COMPANIONSHIP, RELATIONSHIP

SB 1163 enacts new sections of the Public School Code to place restrictions and requirements on

public secondary schools with respect to “post-secondary" recruiters.

HB 789 requires public post-secondary educational institutions to provide on-campus

recruitment opportunities and facilities to military recruiters to the same degree it provides to

members of the public.
