SUMMARY
Synopsis of Bill
Senate Bill 834 amends Section 20-1-4 through 20-12-5 NMSA 1978 to change the name of the
New Mexico State Defense Force to the New Mexico State Guard and to clarify language.
FISCAL IMPLICATIONS
DMA reports the proposed legislation will have no fiscal impact on the department.
SIGNIFICANT ISSUES
Section 20-5-1 NMSA 1978 established the New Mexico State Defense Force as an element of
the militia in the Department of Military Affairs. The State Defense Force consists of persons
between the ages of 18 and 64 years voluntarily appointed or voluntarily enlisted and additional
member of the unorganized militia as may be appointed, enlisted, enrolled or inducted as
provided by law. The officers of the State Defense Force are appointed by the governor and
serve at his pleasure. Currently there are approximately 100 members in the New Mexico State
Defense Force. The Department of Military Affairs’ strategic plan for fiscal year 2008 states the

State Defense Force provides a second militia to respond to the governor’s call for aid in the
event the New Mexico National Guard is unavailable due to serving out of state in the national
interest.
ADMINISTRATIVE IMPLICATIONS
DMA states all policies and procedures relating to the New Mexico State Defense Force will
have to be re-written to implement the change in the proposed legislation.

The proposed legislation is a duplication to House Bill 927.
