SUMMARY
Synopsis of Bill
House Bill 703 changes the name of the Training and Recruiting Division to the New Mexico
Law Enforcement Academy Training and Recruiting Division; requires the director to report
directly to the governor and New Mexico Law Enforcement Academy Board; expands the
powers of the director to be the final decision-making authority, responsible for with approval of
the board for the division as set forth in Section 9-19-9 NMSA 1978 and execute to each
certified law enforcement instructor proper pocket commissions as emergency state
commissioned law enforcement officers; and allows for prioritizing the scheduling of all law
enforcement academy facilities to first and foremost meet the needs of the New Mexico Law

Enforcement Academy, with preference given to other state law enforcement agencies or
organizations based on available space.
FISCAL IMPLICATIONS
DPS states transferring fiscal responsibility of the academy away from the secretary of DPS to
the Law Enforcement Academy director could lead to potentially conflicting issues regarding
spending.
SIGNIFICANT ISSUES
SPO states the proposed legislation’s intent is to provide concise language allowing the division
to maintain autonomy consistent with the division’s purpose and to clarify the director’s
authority.
ADMINISTRATIVE IMPLICATIONS
DPS states that currently the Law Enforcement Academy Board oversees many training issues
and the daily operation of the academy is left to DPS.
OTHER SUBSTANTIVE ISSUES
DPS reports that currently state law does not authorize the instructors to be commissioned as
peace officers.
