SUMMARY
Synopsis of Bill
House Bill 565 appropriates $50 thousand from the general fund for expenditure in FY07 and
FY08 to Cultural Affairs department for the purpose of planning and implementing the annual
Border Book festival in Mesilla.
FISCAL IMPLICATIONS
The appropriation of $50 thousand contained in House Bill 565 is a recurring expense to the
General Fund. Any unexpended or unencumbered balance remaining at the end of FY08 shall
revert to the General Fund.
SIGNIFICANT ISSUES
The Border Book Festival – celebrating its 13th year in April 2007 – has become a nationally
recognized annual event, attracting writers from all over the world. The Festival has been
featured in Publisher's Weekly as one of the top regional book festivals in the U.S. The book-

fair is both a literary event drawing audiences interested in buying books as well as an
educational program for aspiring writers from New Mexico and the Southwest region.
Regionally known authors’ works are prominently displayed and promoted during the festival.
PERFORMANCE IMPLICATIONS
No performance issues for the DCA.
ADMINISTRATIVE IMPLICATIONS
The Department of Cultural Affairs would likely create a memorandum of understanding (MOU)
or professional service contract with the provider.
POSSIBLE QUESTIONS
Would passage of this act possibility violate the anti-donation clause of the New Mexico
Constitution, Article IV., Section 31, Appropriations for Charitable, Educational, etc. purposes.
