SUMMARY
Synopsis of Bill
House Bill 511 appropriates $250 thousand from the general fund to department of Cultural
Affairs for the purpose of creating a commission of 13 governor-appointee members to
coordinate and promote state and local observances of the State’s 100
th
Anniversary;
commemorating inclusion of New Mexico into the United States of America, January 6
th
, 1912.
FISCAL IMPLICATIONS
The appropriation of $250 thousand contained in this bill is a recurring expense to the General
Fund. Any unexpended or unencumbered balance remaining on January 1
st
, 2013 shall revert to
the General Fund. The legislation contains a sunset provision whereby the act would
automatically be repealed on January 1
st
, 2013.

*While the appropriation is considered recurring, the establishment of the New Mexico
centennial fund would allow for continuing appropriations only until the 2013 sunset provision.
House Bill 511 creates the New Mexico Centennial Commission. The secretaries of Cultural
Affairs, Tourism, and Indian Affairs department, in addition to the State Historian shall serve as
ex-officio, non-voting members of the commission. In addition, 9 other members of the
commission would be appointed by the executive and be entitled to mileage and per-diem under
the Per Diem and Mileage Act. The executive shall appoint the chair of the commission.
House Bill 511 creates a new fund and provides for continuing appropriations. The LFC has
concerns with including continuing appropriation language in the statutory provisions for newly
created funds, as earmarking reduces the ability of the legislature to establish spending priorities.
SIGNIFICANT ISSUES
House Bill 511 would require cooperation and the commissions’ soliciting assistance from state
departments and agencies, local governments, schools and societies, and historical, patriotic,
philanthropic, civic and other groups. Additionally, university presidents around the state shall
participate, collaborate and provide research and publication services in conjunction with the
commission’s promotional efforts.
PERFORMANCE IMPLICATIONS
The New Mexico Centennial Commission shall submit its recommendations to the executive
regarding events, projects, and materials selected and produced for the centennial promotion.
House Bill 511 supports the K-12 New Mexico Social Studies Content Standards, Benchmarks,
and Performance Standards as well as other education content standards.
ADMINISTRATIVE IMPLICATIONS
The administrative oversight of the centennial project would fall to the Cultural Affairs
department.
RELATIONSHIP
House Bill 511 relates to appropriations in the General Appropriation Act. $19 thousand was
encumbered to contract New Mexico Heritage Preservation Alliance to provide preservation
planning services pertaining to this centennial celebration in May 2006.
House Bill 477 (and its duplicate Senate Bill 71) appropriates $60 thousand from the general
fund to the Historic Preservation division of the Cultural Affairs department for the purpose of
conducting statewide research, assessment and selection of one of one hundred historic public
structures to be revitalized for the State‘s 2012 centennial celebration.
TECHNICAL ISSUES
House Bill 511 includes provisions allowing the commission to acquire chattel and real property;
provided that chattel be deposited with the State Library or Archives, and that real property be
held by the Cultural Affairs department or Property Control division of GSD.
