SUMMARY
Synopsis of HJC Amendment
The House Judiciary Committee amendment to House Bill 476 adds language requiring a sex
offender to provide written notice of a change in required registration information within 10 days
to the county sheriff.
Synopsis of HCPAC Amendment
The House Consumer and Public Affairs Committee amendment to House Bill 476 adds the
requirement that sex offenders provide their screen names in addition to their email addresses.
Synopsis of Original Bill
House Bill 476 amends Section 29-11A-4 NMSA 1978, the Sex Offender Registration and

Notification Act, to require sex offenders to provide the following additional information to the
county sheriff upon registration: land line number, mobile phone number, pager number and e-
mail address. The proposed legislation also removes gender specific language.
SIGNIFICANT ISSUES
New Mexico Municipal League states the House Consumer and Public Affairs Committee
amendment strengthens the proposed legislation and gives law enforcement officials an ability to
monitor sex offender postings to such websites as “My Space" and “Facebook".
ADMINISTRATIVE IMPLICATIONS
The proposed legislation will require the department to revise forms given to all sex offenders
leaving prison or being placed on parole, so that the offenders know to provide this additional
information to the county sheriff. NMCD reports the revising of the form will not be difficult.
CONFLICT, DUPLICATION, COMPANIONSHIP, RELATIONSHIP
The proposed legislation relates to Senate Bills 439, 450 and 464 which all address issues
regarding sex offenders.
OTHER SUBSTANTIVE ISSUES
Section 9-3-10 NMSA 1978 created the sex offender management board within the New Mexico
Sentencing Commission. The mission of the sex offender management board is to develop and
recommend best practices in the management and treatment of both adult and juvenile sex
offenders for the protection and prevention of current and future victims. The Sex Offender
Registration and Notification Act provides for the identification and monitoring of convicted sex
offenders in New Mexico communities. The sex offender management board monitors changes
in federal law and recommends amendments as necessary to ensure that New Mexico remains in
compliance.
