Synopsis of Bill
The House Transportation and Public Works Committee Substitute for HB 176 requires certain
motor vehicles to be equipped with mudguard flaps and creates a penalty. HB 176 also amends
Section 66-1-4.14 NMSA 1978 to include definitions for “pickup truck" and “sport utility
vehicle".
FISCAL IMPLICATIONS
There will be a minimal but positive revenue impact to the general fund due to the penalty
assessment created.
SIGNIFICANT ISSUES
HB 176 substitute adds a new section to the Motor Vehicle Code stating that on or after July 1,
2007 every new truck, pickup truck or sport utility vehicle sold or purchased in New Mexico for
operation on its streets and highways that has rear tires larger than a tire with a service type
“LT", a section width of two hundred sixty-five millimeters, a sidewall aspect ratio of seventy
percent of the section width and a wheel diameter rating of sixteen inches, or tires designed for
off-road use or use other than customary use on streets and highways, shall be equipped by the
seller with mudguard flaps protecting the rear tires from ejecting material to the rear of the truck,

pickup truck or sport utility vehicle.
HB 176 substitute also requires owners to equip these types of vehicles with mudguard flaps by
July 1, 2012.
The mudguard flaps shall be wide enough to cover the full tread width of the tires, installed as
far to the rear of the motor vehicle as practicable and constructed of a rigid material that is of a
sufficiently rigid character to provide adequate protection.
