SUMMARY
Synopsis of Bill
House Bill 74 appropriates $85 thousand from the general fund to Cultural Affairs department
for the purpose of conducting a conditions assessment and preparing recommendations for
twenty-four sites identified in the federal Galisteo Basin Archaeological Sites Protection Act.
FISCAL IMPLICATIONS
The appropriation of $85 thousand contained in this bill is a nonrecurring expense to the General
Fund. Any unexpended or unencumbered balance remaining at the end of FY08 shall revert to
the General Fund.
SIGNIFICANT ISSUES
The enacted legislation would provide $85 thousand to conduct condition assessments of 24 ar-
chaeological sites within the Galisteo Basin. The sites are eligible for federal preservation funds
under the federal Galisteo Basin Archaeological Sites Protection Act of 2004 (Public Law 108-

208). The federal act provides for a general management plan to be completed within three fis-
cal years of the availability of funds and produced in conjunction with the governor, the State
land commissioner and any affected Native American tribes. The plan would then go to the U.S.
Senate Committee on Energy and Natural Resources and the U.S. House Committee on Re-
sources. However, Congress has not appropriated funding at the federal level thus far. The Of-
fice of Archaeological Studies states that funding will establish a baseline condition index, pos-
sibly hastening federal action.
The Energy, Minerals, and Natural Resources Department (EMNRD) stipulates the importance
of a site assessment for these sites, however, as the federal law becomes effective only upon con-
tingent funding, little has been done at this point. According to EMNRD, an appropriation to
House Bill 74 would assist efforts by the State Parks Division in developing a proposed Cerrillos
Hills /Galisteo Basin State Park. Some sites within the Galisteo Archaeological Site Protection
Network have been considered for inclusion into this park.

Expenditure of the appropriation contained in this bill would be overseen by the Cultural Affairs
department’s office of Archaeological Studies.
WHAT WILL BE THE CONSEQUENCES OF NOT ENACTING THIS BILL
If HB 74 is not enacted, a conditions assessment of these sites would await other sources of fund-
ing such as federal funds.
POSSIBLE QUESTIONS
Is the requested appropriation adequate to provide assessments for this acreage.
