AN ACT

RELATING TO LAND GRANTS; CREATING PROTECTIONS AGAINST ADVERSE

POSSESSION CLAIMS TO COMMON LANDS ADMINISTERED BY LAND

GRANT-MERCEDES THAT ARE POLITICAL SUBDIVISIONS; REPEALING

SECTIONS 37-1-21 AND 47-1-25 NMSA 1978 (BEING LAWS 1857-1858,

P. 64 AND LAWS 1863-1864, P. 54, AS AMENDED).

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new Section of Chapter 49, Article 1 NMSA

1978 is enacted to read:

"ADVERSE POSSESSION.--A land grant-merced managed,

controlled and governed as a political subdivision pursuant

to Chapter 49 NMSA 1978 shall not be subject to adverse

possession claims to or defenses against the common lands

administered by the political subdivision, provided that

those claims or defenses have not vested prior to the

effective date of this section."

Section 2. REPEAL.--Sections 37-1-21 and 47-1-25 NMSA

1978 (being Laws 1857-1858, p. 64 and Laws 1863-1864, p. 54,

as amended) are repealed.
