A MEMORIAL

REQUESTING THE HIGHER EDUCATION DEPARTMENT TO UNDERTAKE A

STUDY OF HIRING POLICIES AND PRACTICES AT PUBLIC INSTITUTIONS

OF HIGHER EDUCATION.

WHEREAS, one public institution of higher education has

repeatedly ignored a legislator's request for copies of hiring

policies; and

WHEREAS, one public institution of higher education does

not routinely advertise in the local news media opportunities

for employment at that institution; and

WHEREAS, it is necessary that public institutions of

higher education follow appropriate hiring policies and

practices to ensure qualified persons are aware of and have an

equal opportunity to apply for employment opportunities; and

WHEREAS, it is necessary that public institutions of

higher education follow appropriate hiring policies and

practices to ensure that the best qualified persons are

offered an opportunity for employment; and

WHEREAS, the hiring policies of public institutions of

higher education should be written, available to the public

and followed in practice;

NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF

REPRESENTATIVES OF THE STATE OF NEW MEXICO that the higher

education department be requested to study the hiring policies

and practices of public institutions of higher education; and

BE IT FURTHER RESOLVED that the department identify the

ethical, constitutional or legal issues, if any, that are

raised given the current faculty and administration hiring

practices of each public institution of higher education; and

BE IT FURTHER RESOLVED that the department study and

recommend options to change laws, rules and policies regarding

the hiring of full-time and part-time faculty members and

administrators; and

BE IT FURTHER RESOLVED that the department report its

findings and recommendations to the New Mexico legislative

council and the legislative finance committee no later than

November 1, 2007; and

BE IT FURTHER RESOLVED that copies of this memorial be

transmitted to the secretary of higher education and to the

chief executive officer of each public institution of higher

education in New Mexico.
