    Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred

SENATE BILL 599

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 2, lines 4 and 5, strike "all records" and insert in lieu thereof "from public access the court records that contain any reference to or record".

    2. On page 3, line 11, after "dismissal" insert "other than a dismissal pursuant to Section 31-20-9 NMSA 1978".

    3. On page 3, line 17, after "sentence" insert "and payment of any fines and fees owed to the state".

    4. On page 4, strike lines 2 through 25 in their entirety and on page 5, strike lines 1 through 5 in their entirety and insert in lieu thereof:

    "The administrative office of the courts and the department of public safety shall develop rules and procedures to implement the Criminal Record Expungement Act, including procedures for notifying the accused of the accused's rights under that act.",

and thence referred to the JUDICIARY COMMITTEE.
