Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred
SENATE BILL 514
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 3, strike line 17 and insert in lieu thereof "and omissions. A physician assistant shall be supervised by a physician as approved by the board."".
2. On page 3, line 18, through page 4, line 1, strike Subsection C in its entirety.
3. On page 18, line 4, strike "licensed by" and insert in lieu thereof "reportable to".
4. On page 18, line 11, strike the quotation mark and between lines 11 and 12, insert the following new subsections:
"C. The board shall give timely notice to the review organization producing peer review records if the peer review records are subpoenaed by a third party, and the review organization shall have standing as a third-party intervener to oppose such production in any action brought by other parties requesting the production of documents produced by the review organization.
D. The board shall not compel any person in the person's capacity as a peer review member or any expert who participates in a peer review process to participate in any board investigation or action resulting from its receipt of the peer review documents.
E. Only documents that are related to the review organization's action that was reportable to the board shall be required to be disclosed in response to the investigative subpoena."".,
and thence referred to the JUDICIARY COMMITTEE.
