AN ACT

RELATING TO HUMAN RIGHTS; CREATING THE REASONABLE ACCOMMODATION REVOLVING FUND; MAKING AN APPROPRIATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. REASONABLE ACCOMMODATION REVOLVING FUND--CREATED.--The "reasonable accommodation revolving fund" is created as a nonreverting fund in the state treasury. The fund consists of appropriations, reimbursements, gifts, grants and donations to the fund. The reasonable accommodation revolving fund shall be used to finance unanticipated reasonable accommodations made by a state agency that hires a new employee who has a disability. The fund shall be administered by the governor's commission on disability, and money in the fund is appropriated to the commission to carry out the purposes of the fund. Disbursements from the fund shall be on warrants issued by the secretary of finance and administration upon vouchers signed by the director of the governor's commission on disability or the director's designee. The fund is subject to department of finance and administration policies and procedures. Purchases for reasonable accommodations are exempt from the provisions of the Procurement Code as provided in Subsection Z of Section 13-1-98 NMSA 1978. An agency that has received a disbursement from the reasonable accommodation revolving fund shall reimburse the fund for the disbursement as soon as fiscally appropriate, provided that such reimbursement takes place by the end of the second fiscal year after the fiscal year in which the funds were disbursed.

     Section 2. APPROPRIATION.--Two hundred thousand dollars ($200,000) is appropriated from the general fund to the reasonable accommodation revolving fund for expenditure in fiscal year 2008 and subsequent fiscal years to carry out the purposes of the fund. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
