AN ACT

RELATING TO CONSTRUCTION INDUSTRIES; PROVIDING MINIMUM STANDARDS FOR NITROUS OXIDE GAS SYSTEMS IN THE CONSTRUCTION OF DENTAL BUILDINGS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Construction Industries Licensing Act is enacted to read:

     "[NEW MATERIAL] ADDITIONAL DIVISION DUTIES--DENTAL BUILDINGS--STANDARDS.--In addition to its other duties, the division shall issue regulations prescribing that a dental office or other facility in which nitrous oxide will be administered without a halogenated agent shall comply with the national fire protection association's level three piped gas and vacuum systems standard for waste anesthetic gas disposal systems. Construction that complies with this section is exempt under the Construction Industries Licensing Act."

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
