    Your LABOR AND HUMAN RESOURCES COMMITTEE, to whom has been referred

SENATE BILL 324, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. Strike all senate finance committee amendments.

     2. On page 1, strike lines 12 through 14 in their entirety and insert in lieu thereof "; PROVIDING FOR AN ANNUAL COST OF LIVING INCREASE; ELIMINATING CERTAIN EXEMPTIONS.".

     3. On page 2, line 4, strike the colon and strike lines 5 through 25 in their entirety.

     4. Strike pages 3 and 4 in their entirety and on page 5, strike lines 1 through 19 in their entirety.

     5. On page 5, line 20, strike "(15)".

     6. On page 5, line 23, after "organizations" strike the remainder of the line and strike line 24 up to the period.

     7. On page 6, line 8, strike "2009" and insert in lieu thereof "2008".

     8. On page 6, line 9, after "pay" insert "an employee".

     9. On page 6, line 10, after the period insert "As of January 1, 2009 and on January 1 of each succeeding year, the minimum wage rate shall be increased as provided in Subsection E of this section.".

     10. On page 7, line 13, strike the quotation mark.

     11. On page 7, between lines 13 and 14, insert the following new subsection:

          "E. On January 1, 2009 and on January 1 of each succeeding year, the minimum wage rate shall be increased by the increase in the cost of living. The increase in the cost of living shall be measured by the percentage increase as of August of the immediately preceding year over the level as of August of the previous year of the consumer price index for all urban consumers, United States city average for all items, or its successor index as published by the United States department of labor or its successor agency, with the amount of the minimum wage increase rounded to the nearest multiple of five cents ($.05). The labor and industrial division of the labor department shall publish by November 1 of each year the adjusted minimum wage rates that shall take effect the following January 1."".

     12. On page 7, line 14 through page 8, line 3, strike Section 3 in its entirety.

     13. Renumber the succeeding section accordingly.

     14. On page 8, line 5, strike "January 1, 2008" and insert in lieu thereof "July 1, 2007".,

and thence referred to the BUSINESS AND INDUSTRY COMMITTEE.
