FOR THE LAND GRANT COMMITTEE
AN ACT
RELATING TO LAND GRANTS; CREATING PROTECTIONS AGAINST ADVERSE POSSESSION CLAIMS TO COMMON LANDS ADMINISTERED BY LAND GRANT-MERCEDES THAT ARE POLITICAL SUBDIVISIONS; REPEALING SECTION 37-1-21 NMSA 1978 (BEING LAWS 1857-1858, P. 64, AS AMENDED).
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new Section of Chapter 49, Article 1 NMSA 1978 is enacted to read:
"[NEW MATERIAL] ADVERSE POSSESSION.--A land grant-merced managed, controlled and governed as a political subdivision pursuant to Sections 49-1-1 through 49-1-18 NMSA 1978 shall not be subject to adverse possession claims to or defenses against the common lands administered by the political subdivision."
Section 2. REPEAL.--Section 37-1-21 NMSA 1978 (being Laws 1857-1858, p. 64, as amended) is repealed.
