AN ACT

RELATING TO MOTOR VEHICLES; REQUIRING COORDINATION OF TRAFFIC SIGNALS IN CERTAIN MUNICIPALITIES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. COORDINATED TRAFFIC SIGNAL SYSTEM.--

          A. As used in this section:

                (1) "controller assembly" means a complete electrical device mounted in a cabinet for controlling the operation of a highway traffic signal;

                (2) "controller unit" means that part of a controller assembly that is devoted to the selection and timing of the display of a traffic signal;

                (3) "manual on uniform traffic control devices" means the manual adopted by the state transportation commission pursuant to Section 66-7-101 NMSA 1978;

                (4) "signal coordination" means the establishment of timed relationships between adjacent traffic signals;

                (5) "signal system" means two or more traffic signals operating in signal coordination; and

                (6) "traffic signal" means a traffic control device by which traffic is alternately directed to stop and permitted to proceed.

          B. A municipality with a home-rule charter pursuant to Article 10, Section 6 of the constitution of New Mexico and with a population over sixty thousand according to the last federal decennial census, in a class A county with a 2006 valuation over five billion dollars ($5,000,000,000) but under ten billion dollars ($10,000,000,000), shall set or program all controller units, which are part of traffic signal controller assemblies, for signal coordination in order to create a signal system that will provide for continuous or nearly continuous movement of traffic at a definite speed. In complying with this section, a municipality shall follow the manual on uniform traffic control devices except as otherwise provided in this section.
