Madam President:

    Your JUDICIARY COMMITTEE, to whom has been referred

     HOUSE CONSUMER AND PUBLIC AFFAIRS COMMITTEE SUBSTITUTE FOR HOUSE BILL 819, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. Strike Senate Rules Committee Amendments 7 and 8.

    2. On page 2, lines 6 and 7, strike "or close personal relationship".

    3. On page 3, lines 6 and 7, strike "to be used by" and insert in lieu thereof "becomes the property of".

    4. On page 3, line 7, strike the comma, strike lines 8 through 10 and strike line 11 up to the semicolon.

    5. On page 3, line 16, after "program" insert "or other activity".

    6. On page 3, line 17, strike the second occurrence of "or" and insert in lieu thereof "provided that in the case of legislators, the program or activity is approved by the New Mexico legislative council;".

    7. On page 3, between lines 17 and 18, insert the following paragraph to read:

             "(10) an educational scholarship or other grant or award that is available to all similarly qualified applicants; or".

    8. Renumber the succeeding paragraph accordingly.

    9. On page 4, line 13, after "lobbyist" strike the remainder of the line, strike line 14 up to the semicolon and insert in lieu thereof "or the lobbyist's employer with respect to matters over which the donee may reasonably be expected to act".

    10. On page 5, line 1, after "A" strike the remainder of the line, strike line 2 up to "shall" and insert in lieu thereof "restricted donor".

    11. On page 5, line 5, before the period insert "or to the family of any one officer, employee or candidate".

    12. On page 5, line 12, after the period insert:

    "An agent of a business or corporation regulated by a public agency shall not donate to a charity in response to a solicitation for that charity from a public officer or employee of that public agency.".
