AN ACT

RELATING TO THE NEW MEXICO LOTTERY; CREATING A LOTTERY OVERSIGHT COMMITTEE; ASSIGNING OVERSIGHT OF THE NEW MEXICO LOTTERY AND THE NEW MEXICO LOTTERY AUTHORITY TO THE LOTTERY OVERSIGHT COMMITTEE.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 6-24-1 NMSA 1978 (being Laws 1995, Chapter 155, Section 1) is amended to read:

     "6-24-1. SHORT TITLE.--[Sections 1 through 34 of this

act] Chapter 6, Article 24 NMSA 1978 may be cited as the "New Mexico Lottery Act"."

     Section 2. A new section of the New Mexico Lottery Act is enacted to read:

     "[NEW MATERIAL] LOTTERY OVERSIGHT COMMITTEE--CREATED--MEMBERSHIP--DUTIES.--

          A. A joint interim legislative committee is created that shall be referred to as the "lottery oversight committee".

          B. The lottery oversight committee shall be composed of four members. Two members of the house of representatives shall be appointed by the speaker of the house of representatives and two members shall be appointed by the senate committees' committee or, if the senate appointments are made during the interim, by the president pro tempore of the senate, after consultation with and agreement of a majority of the members of the senate committees' committee. Members shall be appointed so that there are equal numbers of members from each of the major political parties from each house. A person who has a financial interest in a lottery contractor, lottery retailer or lottery vendor shall not be appointed to the committee.

          C. The lottery oversight committee shall oversee the operations of the authority, as well as periodically review and evaluate the success with which the authority is accomplishing its duties and shall ensure the authority is operating the lottery pursuant to the New Mexico Lottery Act. The committee may conduct an independent audit or investigation of the lottery or the authority.

          D. The lottery oversight committee shall report annually its findings and recommendations on the lottery and the operation of the authority to each regular session of the legislature."

     Section 3. REPEAL.--Section 6-24-9 NMSA 1978 (being Laws 1995, Chapter 155, Section 9, as amended) is repealed.
